Lawyer warned about jail time for publishing other people's personal data
Publishing someone else's personal data without a person's consent may result in criminal liability. This was announced on January 7 by Vitaly Shakin, senior partner of ICA "Yurcity", lawyer, Candidate of Law.
The lawyer explained that personal information includes not only address, phone number or passport information, but also any information related to a person's private life. This includes personal correspondence. He recalled that back in 2012, the Constitutional Court of the Russian Federation pointed out the confidential nature of any information about private life, therefore, the dissemination of such data without consent violates the personal rights of citizens.
Shakin noted that responsibility for the illegal dissemination of personal information depends on a number of circumstances. According to the lawyer, in case of leakage of personal data, the victim has the right to demand compensation for moral damage. In addition, the norms of Article 152.2 of the Civil Code of the Russian Federation allow through the court to stop the dissemination of information and its removal.
"In more severe cases, criminal liability is imposed under Article 137 of the Criminal Code of the Russian Federation for the illegal dissemination of information about private life. The maximum penalty under this article is up to two years in prison, and if the information concerns a minor — up to five years," Shakin said in an interview with the newspaper.Ru».
On September 29, it was reported that Russia wants to introduce guaranteed payments to victims of personal data leaks. The All-Russian Union of Insurers (VSS) proposed obliging operators of such data to insure risks or form a special fund for payments.
