The court rejected the claim for cancellation of Coca-Cola trademarks in Russia

The Intellectual Property Rights Court rejected the claim of Coca-Cola Company LLC, registered in South Ossetia, to terminate the legal protection of The Coca-Cola Company trademarks in Russia. The relevant document was published on July 21 on the website of the arbitration file system.

The plaintiff tried to challenge four trademarks with a verbal element of Coca-Cola, including those registered in the USSR in 1927 and having the status of well-known in the Russian Federation since 1996. The South Ossetian company applied to Rospatent for registration of a similar designation, but was refused due to its similarity to the brands of the American corporation. After that, she initiated the procedure for the early termination of the legal protection of trademarks due to their non-use in Russia.

The court rejected the claim in full. Earlier, the Moscow Arbitration Court began considering The Coca-Cola Company's claim to ban the South Ossetian company from using its brand name in Russia.

Does this mean the return of brands to the domestic market

Oleg Paroev, CEO of Yummy, announced on July 11 that the American McDonald's restaurant chain would probably not return to the Russian market. He noted that the possible return of the company is influenced by the geopolitical changes that have taken place.

On May 13, McDonald's registered 14 trademarks in Russia. Among them are McCafe, Ronald McDonald House and McCrispy. These brands are also designed in the Russian version — "McCafe", "Ronald McDonald's House" and "MccRispie".
