Lawyer Yeremenko allowed Dolina to win in the Moscow City Court
The Moscow City Court may decide in favor of singer Larisa Dolina in the case of eviction from an apartment owned by Polina Lurie. About this on December 25 in an interview with "Gazeta.Ru," said lawyer Nina Yeremenko.
"If it were a matter of formally confirming the previous conclusions, this would not be necessary," Eremenko said, commenting on the appointment of a second psychological and psychiatric examination.
According to the lawyer, the re—examination confirmed that at the time of the transaction, Dolina was in a state of stress, fear and delusion - the same conclusions as before. However, the fact of the new study indicates that the court intends to seriously review the circumstances of the case, and not just formally approve the previous decision.
Yeremenko stressed that Dolina's side would insist on the singer's vulnerable condition during the transaction and on the lack of due diligence on the part of the buyer. She also noted that in such transactions it is necessary to obtain a certificate from a neuropsychiatric dispensary, even if it is a public figure.
The lawyer did not give percentage estimates of the chances, but called them "not low." She drew attention to the fact that public optimism after the case is returned for consideration may be premature — the process is still far from being completed, and the legal picture may change.
"Now it feels like everything has already been decided. But this is not the case. This case is still alive, and it really should be closely monitored," Yeremenko concluded.
On December 16, the Supreme Court of the Russian Federation recognized the ownership of the disputed apartment by Dolina to the buyer Polina Lurie. It was clarified that the court also decided to cancel all decisions of the lower courts in the case of the sale of the artist's apartment.
Later, on December 19, Dolina, after receiving a request for eviction from the apartment from her new owner, Lurie, reported the fraud to the police. Lurie's lawyer Svetlana Sviridenko, in turn, said that the singer continues to stay in the Moscow apartment, which the Supreme Court of Russia recognized as the property of the buyer.
On December 21, the Supreme Court of the Russian Federation, in a text on the complaint of the buyer of the apartment, Lurie, said that Dolina's delusion at the time of the sale of the apartment was not a sufficient reason to cancel this transaction. The court noted that only significant misconceptions of the party are recognized as a defect in the transaction, in the absence of which a person, reasonably and objectively assessing the situation, would not have made the transaction at all.
