The defendants in the case of poisoning with the salad of the "Kitchen in the area" extended the arrest

The Lyublinsky District Court of Moscow extended until June 1 the preventive measures in the form of house arrest and detention of four defendants in the case of the massive botulism disease caused by Lobio salad from the restaurant "Kitchen on the district" in Moscow. This was reported on December 9 by a correspondent of Izvestia.

The defendants are charged under Part 3 of Article 238 of the Criminal Code of the Russian Federation ("Production and sale of food products that do not meet safety requirements, resulting in the death of two persons by negligence"). One of them, Vladimir Shin, director of the Savon-K canned bean manufacturing company, is also charged with Art. 322.3 of the Criminal Code of the Russian Federation ("Illegal registration of foreign citizens"). He and two other defendants in the case were placed under house arrest. The cook of Savon-K, Karim Normatov, is in custody.

According to the Prosecutor General's Office, in May-June 2024, Shin purchased beans and instructed a worker without appropriate knowledge to cook and pack them in a vacuum. Due to violations of sanitary standards, botulinum toxin was formed in the products.

Later, this bean was acquired by the Lokalkitchen company. The investigation found that CEO Anton Lozin and the head of the quality department, Elena Mashkova, decided to save money and did not carry out the necessary checks. A Lobio salad was made from the beans, which was sold through the Kitchen in the Neighborhood and the Scooter delivery service.

As a result of poisoning by the dish, two people died, 298 more people were hospitalized in serious condition, and 52 victims escaped serious consequences thanks to timely medical care.

It was also established that Shin illegally registered 31 foreign employees at his mother's address. The victims are demanding compensation in the amount of more than 70 million rubles, and Lokalkitchen has already paid part of the damage.

In June last year, Rospotrebnadzor launched an investigation after the poisoning cases. A criminal case was initiated under Article 238 of the Criminal Code of the Russian Federation ("Provision of services that do not meet the requirements for the safety of life and health of consumers").

On September 23, the court dismissed a claim for compensation for moral damage to Muscovite Nelly Matveeva, who claims that she suffered botulism after eating products purchased through the Scooter delivery service. Then, representatives of Smart Retail LLC (Samokat service) throughout the entire process expressed their willingness to conclude an amicable agreement, but the proposed amount of compensation did not suit the plaintiff.

In December 2024, the first substantive court hearing was held on this claim. During the meeting, it became known about the intention of Smart Retail to conclude a settlement agreement, but the victim was not satisfied with the amount of compensation. Later, the court involved a bean producer as a third party in the claim of the victim of botulism.
