The procedure for reviewing court decisions may change in Russia

The list of grounds used to launch a review of court decisions will be significantly expanded. Thus, they will be able to use previously issued decisions on the refusal to initiate cases or their closure, where false information from witnesses or experts appeared. Such a document was approved by the government commission on legislative activity, sources told Izvestia.

The bill is aimed at filling in gaps in federal legislation related to the previously missing possibility of using final procedural decisions that resolve a criminal case on the merits for the purpose of reviewing judicial acts issued in the framework of civil, arbitration and administrative proceedings, explained Ekaterina Kharchenko, Senior associate at Criminal Defense Firm.

"At the beginning of 2025, the Constitutional Court of the Russian Federation said that not only court verdicts, but also other procedural decisions in a criminal case, including those taken at the preliminary investigation stage, may contain the necessary evidentiary information indicating the need to review the already established court decision in a special manner, since the circumstances are special. Previously, according to the law, this could not be done, and the Constitutional Court of the Russian Federation said that it was unconstitutional," she recalled.

Not all criminal cases go to court for objective reasons, lawyer Alyona Tikhomirova added. Meanwhile, at the stage of the preliminary investigation, circumstances essential to the review of the case may also be established, which must be taken into account by the courts when making decisions.

"Now, for the court that will review the case, it will be important not so much the form itself as the content of the document, which makes justice more accessible," she said.
