The lawyer warned of a triple increase in alimony in 2026 in a number of cases

Starting in the spring of this year, the procedure for calculating child support will change — now the amount of payment will be determined not by the minimum wage (minimum wage), but by the average monthly nominal salary in the regional economy for the previous year, which in some cases may lead to a threefold increase in the amount of payments due to minors. This was announced on Thursday, January 8, by Olga Novikova, Head of the Novikova & Partners Law Center.

According to her, after the new methodology comes into force, which is scheduled for March 1, 2026, the general procedure for paying alimony will not be changed — the proportions of deductions will remain the same: one quarter of income for one, one third for two, half for three or more children.

Illustrating the innovation, Novikova turned to the example of a parent from the Krasnodar Territory.

"Now, let's say there is a father, but the parents are not married. A mother must have minimum alimony (by notarial or oral agreement) in the amount of 25% of the minimum wage — 5,610 rubles in 2025 (minimum wage 22,440 rubles in 2025). According to the new approach, the limit will be calculated based not on the minimum wage, but on the average monthly nominal salary for the region's economy over the previous year," she said in an interview with Gazeta.Ru».

At the same time, the year before last, the average nominal salary in the region was 70,410 thousand rubles. So, according to the new calculation, a divorced person who has one child will have to pay 17,602 thousand rubles.

The lawyer also recalled that since May 25, 2025, the FSSP electronic registry has been operating in the Russian Federation with data on malicious alimony defaulters, whom employers are required to check when applying for a job. When the debtor is found, they must begin withholding payments. Novikova noted that the best option for a constructive relationship between parents is a notarized alimony agreement. If it is not possible to reach an agreement, you should apply to the court with the necessary package of documents, including the calculation of the required amount.
