On December 16, 2025, the Judicial Board for Civil Cases of the Supreme Court of the Russian Federation overturned the decisions of the lower courts in the dispute between Larisa Dolina and Polina Lurie on the invalidation of apartment sales transactions and returned for a new review part of the eviction claims. The essence of the proceedings

Dolina went to court to challenge the sale of her apartment. She claims that the transactions (the preliminary agreement and the main purchase and sale agreement) were conducted with violations: according to her, she was pressured, misled, and at the time of signing the documents, her mental state was unstable. Dolina is asking the court to cancel these agreements, return her ownership of the housing and recognize that the current owner, Polina Lurie, is not the rightful owner.

In response, Pauline Lurie filed a counterclaim. She demands that Larisa Dolina and her relatives (daughter and minor granddaughter) be evicted from the apartment and removed from registration. Lurie insists that she became the rightful owner after the official registration of the transaction in June 2024, and the seller (Dolina) was obliged to vacate the premises, but did not do so.

Court decisions and conclusions of the Supreme Court

The Supreme Court of Russia overturned all previous court decisions in the case of Larisa Dolina and returned the apartment to her buyer, Polina Lurie. Earlier, the district court, the appeal and the cassation sided with the singer, declaring the sale invalid due to her "significant misconception" and returning ownership to her.

However, the Supreme Court pointed out that the lower courts had applied the law incorrectly. In the opinion of the highest court, personal motives or a lack of understanding of the legal consequences of the transaction alone are not sufficient grounds for its cancellation. The court also noted that during the consideration of the dispute, the conscientiousness of the buyer's behavior was not properly assessed and the necessary forensic psychiatric examination was not carried out to prove Dolina's inability to account for her actions at the time of the transaction.

As a result, the Supreme Court issued a new decision: to reject Larisa Dolina's claim for invalidation of the transaction, which means that Polina Lurie retains ownership of the apartment.

What is the current status of the case?

The Supreme Court finally rejected Larisa Dolina's attempt to cancel the sale of the apartment. Now the transaction has been recognized as legitimate, and the ownership remains with the buyer Polina Lurie.

However, the issue of evicting the singer and her family from this apartment has not yet been resolved. The Supreme Court sent this part of Lurie's claim for a new hearing to the Moscow City Court, stating that judges must carefully consider the right to housing, including for Larisa Dolina's minor granddaughter. Thus, the dispute over whether the Dolina family should leave the premises will continue.
