The trial in the case of the demolition of an illegal annex in an elite residential complex in Moscow was delayed

The housing scandal in the center of Moscow, related to an illegal extension in an elite residential complex, continues to develop, and the court proceedings in the case of the demolition of an illegal terrace are being delayed. On Friday, December 5, another meeting was held.

A class action lawsuit was filed by the residents of the complex, who had previously managed to prove that the terrace was attached to the first floor of the building illegally, and the signatures allegedly collected in support of the construction turned out to be fake.

At a new hearing on December 5, the Zamoskvoretsky Court did not consider the case and transferred it to another court. The lawyers will appeal this decision.

"Today, the court considered the procedural issue of the jurisdiction of the Zamoskvoretsky Court. The judge concluded that the case was beyond the jurisdiction of the court, and referred it to the Simonovsky Court for consideration. We do not agree with this, we will appeal this, because there is a special rule according to which all disputes about real estate and the demolition of unauthorized buildings are considered at the location of the facility," commented lawyer Oleg Sukhanov.

The owners of the apartments in the residential complex conducted an independent examination of the extension, which showed that the additional weight increased the load on the foundation by 15 tons. Because of this, microcracks appeared on the facade of the house.

Builders call the problem "exaggerated"

Earlier, on November 24, the court declared the extension and its construction permit illegal. It was clarified that the owner of the apartment on the ground floor, Nadezhda Domokurova, decided to increase its area and attached part of the facade, which belongs to all residents. They tried to convince Domokurova to stop the work, but she ignored their requests.
