Roskachestvo clarified the legality of the stores' demands to pay in cash
Roskachestvo experts explained that some enterprises may not provide the possibility of paying with a bank card.
In conversation with Lenta.Ru On Wednesday, October 21, experts noted that under current legislation, organizations with annual revenues of over 20 million rubles are required to provide the possibility of non-cash payment for goods and services. However, an exception is provided for individual outlets with revenue of up to 5 million rubles per year. Therefore, small shops, workshops, and microenterprises can legally accept only cash.
At the same time, experts emphasized that regardless of the payment method, the seller is obliged to issue a fiscal check in accordance with Law No. 54-FZ. A document with a QR code confirms the purchase and allows you to make a refund or exchange of goods, if necessary. Therefore, it is recommended to accept a cash payment only if a check is issued.
If the seller refuses to provide the receipt, Roskachestvo advises requesting a book of reviews and suggestions. And in the case of a reference to a faulty terminal, experts recommend offering an alternative payment method, for example, payment by QR code, writes Moscow 24.
Regina Dolotina, associate Professor of the Gusov Department of Labor and Social Security Law at Kutafin University (MGUA), told the Moscow City News agency on October 15 that employees of Russian companies have the right to ask their employers to pay their salaries in cash instead of transferring them to a bank card amid attacks on bank data centers. The employee also has the right to replace the credit institution to which the salary is to be transferred.
In September, civil lawyer Alla Georgieva, in an interview with RT, said that the price cannot change due to whether a person pays in cash or by card for a product or service.
At the same time, lawyer Yulia Suvorova stated that the only legitimate reason for the bank's refusal to accept cash was the absence of a cash register in a particular branch.When faced with an unjustified refusal, she recommended clarifying the reason for it and contacting the bank for official explanations.
