Throwing garbage out of the window can lead not only to conflicts with neighbors, but also to administrative or criminal liability. This was reported to Izvestia on April 10 by Dmitry Bondar, a public figure and housing and communal services expert.

According to the expert, in such situations, the first step is to try to solve the problem peacefully. A calm conversation with a neighbor can be more effective than complaints and appeals to regulatory authorities.

The expert clarified that criminal liability is unlikely for a single case that did not entail serious consequences. However, such actions can be classified as an administrative offense.

In particular, we are talking about Article 8.2 of the Administrative Code of the Russian Federation, which provides for fines for non-compliance with waste management rules. The amount of penalty for citizens can reach 3 thousand rubles, and in case of repeated violation — up to 5 thousand rubles.

"The transition to the category of a criminal act, in my opinion, occurs when serious consequences appear. For example, due to a fallen object, someone was seriously injured, a case may be initiated under Article 118 of the Criminal Code of the Russian Federation, which may result in restriction of liberty for up to three years," Bondar said.

Video recordings, witness statements, as well as acts of the management company can be used to establish the guilt of the violator. If property damage has been caused, an expert assessment will be required for the subsequent recovery of compensation through the court.

Ilya Vasilchuk, a judicial lawyer, an expert on the security of electronic transactions and real estate transactions, and a public figure, said on April 9 that an employer has the right to apply disciplinary measures to an employee for a strong smell of food if it violates the company's internal rules and interferes with colleagues. According to Vasilchuk, the key condition is the availability of relevant requirements in the company's internal documents — labor regulations, employment contract or code of ethics.
