The employer has the right to send an employee on vacation against his will. Evgenia Gankina, director of the Roskachestvo Organizational Development Department, told about this on Tuesday, February 3.

According to Gankina, there is no norm in the Labor Code of the Russian Federation that explicitly states the specific number of accumulated vacation days after which the employer has the right to send an employee to rest against his will, but this does not mean that it is possible to postpone the vacation indefinitely and that the employer has no tools of influence.

"According to Article 124 of the Labor Code of the Russian Federation, annual paid leave must be provided to an employee annually. The employer has no right not to provide it for two consecutive years [at the request of the employee to accumulate days]. In addition, the law requires that at least one part of the vacation should be at least 14 calendar days in a row," Gankina said in an interview with Lenta.Ru .

Gankina noted that in practice this means that if an employee has accumulated more than 56 vacation days in two years, the employer is obliged to take measures to ensure that the employee uses the vacation, writes Life.Ru .

The expert noted that the legal way is to send a vacation according to an approved schedule with two weeks' notice, even if the employee is against it, RT reports.

She stressed that sending an employee on vacation without pay (at her own expense. — Ed.) it is impossible under any circumstances — Article 128 of the Labor Code of the Russian Federation allows such leave only on the initiative of the employee.

Earlier, on February 1, Alexander Yuzhalin, head of the SuperJob legal practice, said that Russians who work according to a five-day schedule expect only 19 working days in February, the remaining nine days will be weekends.

The expert explained that Russians will have a rest during one of the five-day working weeks on Monday, February 23. This is due to the celebration of Defender of the Fatherland Day.
