The lawyer shared a way to get money back from paying off other people's debts.
In order not to pay for the debts of a person with the same full name, you need to quickly contact official structures to confirm that you are not involved in the debt. Anastasia Lyapunova, Head of the Bankruptcy and Corporate Disputes Practice at Lyapunov, Terekhin & Partners, told the Prime news agency on January 11.
"Ask the bank for the basis of the write—off / arrest and the details of the enforcement document [the number of the enforcement proceedings, the division and the bailiff's data] in order to understand what the root cause is, and so that your appeals are linked to a specific enforcement proceeding," the lawyer noted.
According to her, it is also necessary to collect a package of documents confirming non-involvement in debts and send them to the Federal Bailiff Service.
"Then assemble a package that allows you to clearly distinguish you from the debtor: passport (photo and registration page), SNILS, INN, if available, information about your place of work/residence, and other documents confirming that you are not the person against whom the enforcement document was issued," Lyapunova explained.
In case of delays, you should complain to your superiors or go to court.
Such cases are rare in Russia today, as the approach to identifying payers is periodically complicated, but they are not excluded.
