He explained that the ex-spouse's income may be unstable, or he intentionally hides part of his income in order not to pay a percentage of alimony from them. In such cases, when it is not possible to reach an agreement, the expert advised asking the court to assign alimony in hard monetary terms.

"This amount is linked to the subsistence level for a child in your region and is a kind of anchor that prevents payments from falling to the symbolic "three kopecks per quarter." In addition, if the payer has at least some official income, you can apply for a mixed alimony option - interest on "white" earnings and a fixed amount on top. Payments can be withheld even from unemployment benefits," he said.

If there is a certainty that the spouse is hiding his true income, evidence will be required in court. You can take pictures of a car, tickets for a vacation abroad, or any other evidence of material well-being.

"The bailiff service is becoming the main ally in this situation. Send a request to verify the defaulter's real income. Access to information from banks, the tax service, and the Pension Fund allows bailiffs to successfully identify hidden financial flows. The deadline for responding to a request for recheck is ten days," the lawyer stressed.

He also recalled that the consequence of non-payment of alimony may be the seizure of accounts and property, a ban on leaving the country, or even criminal prosecution and further deprivation of parental rights.

Earlier, on October 31, the head of the FSSP, Dmitry Aristov, said in an interview with Izvestia that the Russian Ministry of Justice, together with the FSSP of Russia, is working on the issue of refusing debtors on alimony obligations included in the register to provide a number of public services.
