The Constitutional Court is asked to review the rules on digital assets
In Russia, the possibility of clarifying the legal regulation of judicial protection of digital currencies is being discussed. Marat Amanliev, Managing Partner of the Right Side Law Firm, has filed a complaint with the Constitutional Court of the Russian Federation, challenging the refusal of judicial protection of the rights of cryptocurrency owners due to failure to notify the Federal Tax Service.
"The essence of our complaint is as follows: there are many different types of property in civil circulation, be it cars, apartments or jewelry, and the Russian Constitution guarantees equal protection to all owners," Marat Amanliev told Izvestia.
According to him, digital currency is recognized as property and belongs to objects of civil rights, however, Federal Law No. 259-FZ "On Digital Financial Assets" introduces a restriction — the right to judicial protection of digital currency owners is granted only if they have informed the state about the facts of ownership and transactions in accordance with the procedure established by tax legislation.
