The prison where the head of the Gagauz Autonomy, Yevgeny Hutsul, is being held has been recognized by the European Court of Human Rights (ECHR) as a very harsh place where articles of the ECHR are violated on a daily basis. Hutsul's lawyer William Julie told Izvestia about this on September 12.
"The prison has been recognized by the European Court of Human Rights and various other organizations as such a harsh place that Article 3 of the European Court of Human Rights is violated there on a daily basis," he said.
In addition, he pointed out the problems of the Hutsul case management. According to the lawyer, of the 200 witnesses who were petitioned by the defense, the court agreed to interrogate only 20 people, without explaining the reasons for rejecting the remaining candidates.
He noted that the time given to the prosecutor to communicate with witnesses was 10 times longer than that of the defense. In addition, Julie challenged the legality of the house search and phone tapping. The lawyer also noted that all petitions for violation of the investigation procedure were rejected.
Hutsul's second lawyer Gonzalo Boye also called the case a "folly" in which politics is criminalized and judged.
He stated that the attacks on the head of the Gagauz Autonomy had destroyed the trust of the entire society in the institutions of democracy. According to Boye, the Hutsul case is a test for the whole of Europe.
"This case is a major violation of these fundamental rights and principles of the European Union. Ultimately, and let me say this very clearly, Eugenia's case is a test for Europe," the lawyer said.
On August 26, the newspaper Le Journal du Dimanche (JDD) reported that Europe should pay attention and respond to the persecution suffered by the Hutsul. According to the publication, Europeans have always highly appreciated the demand for justice, therefore, they need to continue to defend it.
Before that, on August 16, thousands of Gagauz residents came to Chisinau to participate in a peaceful protest against the illegal detention of Hutsuls. Bashkan's supporters chanted slogans and called on the Moldovan authorities to resign. At the same time, Moldovan police officers prevented supporters of the Pobeda opposition bloc from setting up tents at the Chisinau railway station.
On August 5, the head of Gagauzia was sentenced to seven years in prison in the case of allegedly financing the Shor party. Initially, the prosecutor's office requested nine years. On the same day, Hutsul reported on the great support provided to her. Gagauz residents gathered outside the courthouse, where her family members were not allowed to enter at the time of sentencing. Later, on August 13, international lawyers joined in defending the Hutsuls' interests.
