In the Sverdlovsk Region, the Ural Bank for Reconstruction and Development (UBRiR) has recognized a Russian resident living in another region of the country as deceased. The Russian woman herself told Izvestia about this on July 31.
According to the woman, her adult child was summoned to the Asbestos City Court as her heir to the loan obligations. According to the bank, the woman allegedly died in August last year, and the loan in her name was issued a year earlier, when she herself was in another region and could not sign the necessary documents. At the same time, there is no such agreement in the Russian woman's credit history.
It is noted that the bank's representatives did not appear in court, hoping that the case would be considered in absentia. The woman who came to court stated that the bank had not provided any evidence of signing a controversial loan agreement with her.
At the same time, the Russian woman had to appear at the meeting as a witness, since due to her alleged death she could not be involved as a defendant. The court ruled that the plaintiff violated the writ and did not check the information about the debtor's death, and therefore the claim was dismissed.
On June 8, lawyer Elena Kuderko said that upon receiving an inheritance, not only property is acquired, but also the debts of the deceased. According to her, the law does not allow accepting part of the inheritance. However, the heirs are responsible for the debts of the deceased only within the limits of the value of the property they received, which is determined on the day of the opening of the inheritance. To do this, an appraiser is invited, who draws up a report and determines the market value of the property.
