Google faces 65 million rubles for each claim in the American arbitration
The Moscow Arbitration Court has granted a request to ban the Irish office of Google from continuing legal proceedings in US arbitration in cases related to the contesting of transactions by the bankruptcy trustee of the subsidiary Valery Talyarovsky in the bankruptcy case of Google LLC. The relevant information follows from the court's ruling, which appeared at the disposal of Vedomosti.
It is specified that more than 65 million rubles can be collected from Google Ireland Limited for each claim. It is noted that the measures in the form of a ban on the proceedings are justified, since the company's Irish office continued the proceedings in the US District Court for the Northern District of California, contrary to the ban.
According to the court's decision, the enforcement of judicial acts of the United States arbitration court before considering the case on its merits may lead to losses for Google LLC. It is noted that the company "will actually lose the opportunity to carry out legitimate bankruptcy activities."
As noted, Google Ireland Limited insisted on reviewing his application for challenging the transactions not by a bankrupt court, but by a foreign commercial arbitration. According to Talyarovsky, this is impossible due to foreign sanctions and Google's actions. The contesting of bankruptcy transactions belongs only to the competence of the State court.
"The bankruptcy of [Google LLC] is caused by the parent companies (Google International LLC and Google LLC) following foreign anti-Russian sanctions, based on which Google illegally blocked the YouTube channels of a number of Russian media outlets, current creditors," Talyarovsky notes.
On January 31, the Moscow Arbitration Court granted the petition of the bankruptcy trustee of Google LLC to ban Google Ireland Limited from continuing to pursue a lawsuit in the Northern District Court of California in the United States, responding to an unprecedented ban by the American court.
