The Supreme Court of Russia (SC RF) has sent for review a case filed by a resident of St. Petersburg, who issued a bank loan under the influence of fraudsters who stole more than 1.3 million rubles from her account. This was reported on January 29 in the judicial instance.
The woman appealed to the court with a demand to declare the loan agreement invalid and indicated that she had become a victim of telephone fraud. According to her, an unknown interlocutor convinced her to dictate a text message code, ostensibly to cancel the loan, but in fact this code confirmed its registration. After gaining access, the attackers debited more than 1.3 million rubles from the bank account.
The plaintiff stressed that she had not intended to take out a loan and had been misled. She also said that the bank, despite the suspicious nature of the transaction and the subsequent transfer of funds in equal amounts to different accounts, had not taken measures to protect her rights. The court of first instance dismissed the claim, believing that the client had consented to the transaction and had the opportunity to make an informed decision. After that, the case was referred to the Supreme Court.
