The lawyer named the reason for the fines of business owners for music
Owners of cafes, beauty salons, and private medical clinics across Russia have begun receiving fines of up to 5 million rubles for using music. This was announced on December 2 by Vladimir Entin, the lawyer of the Moscow Law Firm Klishin and Partners.
According to the lawyer, the Russian Copyright Society (RAO) and the All-Russian Intellectual Property Organization (WIPO) have received accreditation from the Ministry of Culture of the Russian Federation to collect awards in the interests of copyright holders of music, both with and without text. This permission gives the right to collect remuneration not only for authors who have concluded an agreement with RAO and WIPO, but also for those who have not refused to participate.
"Based on these circumstances, RAO began to actively investigate whether radio broadcasting and television music channels (over-the-air and cable broadcasting) are used in cafes, beauty salons and other business outlets. All these actions are risky without an agreement with RAO. Especially within the framework of the legislation of the Russian Federation, which doubled the upper amount of expected compensation in connection with illegally used copyrights," Entin said in an interview with Gazeta.Ru».
The lawyer noted that large fines are usually associated with the use of music as the main object. However, in businesses such as cafes or pizzerias, music is just a background accompaniment, and it is easy to abandon it. For example, by installing an ordinary mechanical record player.
According to the expert, there are two possible solutions to this situation. The first is the conclusion of an agreement with representatives of the RAO, who will specify the terms of use of the music. The second option is to find ways to play music without using over—the-air and cable broadcasting, for example, through a mechanical turntable or a music box for coins.
