The court confirmed the possibility of disqualification for driving an electric scooter while drunk

Drivers of electric scooters with an engine power of more than 0.25 kW may be deprived of their driver's license for driving while intoxicated. Information about this follows from the decision of the Supreme Court of Russia dated July 21 this year.

According to the document, the Supreme Court upheld the decision of the lower authorities in the case of Alexander Tatarintsev, a resident of the Voronezh Region, who was deprived of his license for 1 year and 10 months and fined 30,000 rubles for driving an electric scooter while intoxicated.

"There is no doubt about the legality of bringing him to administrative responsibility," the Supreme Court said in its ruling.

According to investigators, on April 14, 2024, Tatarintsev was driving an electric scooter without license plates in the village of Anna, where he was stopped by traffic police officers. A medical examination confirmed that the man was drunk.

Tatarintsev insisted that his electric scooter was a means of individual mobility (SIM) and should not fall under the rules for vehicles, but the court considered his actions a violation, since the scooter had a power of 600 watts, which corresponds to the characteristics of a moped. The court also noted that a driver's license of category M is required to operate such vehicles.

The court's ruling does not apply to electric scooters with low power, as well as bicycles and electric bicycles.

On August 19, Russia proposed exploring the possibility of introducing special insurance for users of personal mobility equipment (SIM), including electric scooters, which would work on the principle of CTP, but would be voluntary. According to the initiative, such an insurance product should provide for long-term life and health insurance of the SIM user and liability to third parties, as well as compensation payments in connection with damage to other people's health, property or infrastructure.
