Management companies, along with the chairmen of the houses, will no longer be able to fake the results of residents' meetings. Starting in September 2025, personal data of apartment owners will be excluded from the register of owners in Russia, according to a draft government decree. Why are the CC faking the results of meetings

Starting in September 2025, personal information about apartment building residents will be removed from the register of owners in order to prevent misuse of confidential information. This follows from the draft government decree on amendments to the Housing Code, which was reviewed by Izvestia. In particular, the initiative will make it more difficult for management companies to document fake meetings.

Now the initiators of the vote are requesting data on tenants from the register of owners, which is maintained by the Criminal Code. She, in turn, is obliged to provide this information within five days. The consent of the owners of the MCD to transfer personal data is not required.

The new measure will change the order of meetings at home. The initiator of the discussion must organize a vote on the list of apartments, and citizens will provide personal data for protocols and documents on the rights to premises independently. That is, they will have to confirm their identity before each vote on property issues, otherwise the meeting will not receive a quorum, follows from the explanatory note to the document prepared by the Ministry of Construction.

Deputies often receive complaints about the collusion of the chairmen of the councils of apartment buildings with the leadership of the Criminal Code.

"Some criminal codes increased maintenance tariffs in this way, referring to fake decisions of meetings," Sergei Pakhomov, chairman of the State Duma Committee on Construction and Housing and Communal Services, told Izvestia.

According to him, managers can also sign acceptance certificates for substandard work if the management Company lobbies the interests of its contractors. They can also coordinate the creation of fictitious "reserve funds" within the framework of the powers delegated by the owners.

Such meetings are often held "on paper," and decisions are made in the interests of the governing organization, she added.

How are the residents' meetings going?

Currently, there are two forms of meetings in Russia: face-to-face and correspondence

In person, the voting participant presents a passport and a document of ownership (for example, an extract from the Unified State Register of Legal Entities). The vote is recorded in the protocol with the signature of the apartment owner," added Sergey Pakhomov. — It is difficult to deceive someone here.

In absentee voting, signatures are easier to forge, since sometimes the expression of the will is executed without the participation of a citizen using his personal data obtained without consent, the deputy explained.

To protect their interests, the owner can now transmit his decision to the initiators of the vote in writing with a signature certified by a notary or the Criminal Code, or come to the meeting in person.

To simplify the voting procedure, the Ministry of Construction relies on the electronic GIS housing and communal services system. It eliminates the falsification of protocols, increases the transparency of voting and reduces the risks of falsification of results, the agency told Izvestia.

— We have consistently adopted several laws that develop the State GIS Housing and Communal Services Information System, — said Sergey Pakhomov. — So far, management companies are not actively using this tool, but residents have already fallen in love with it.

The expansion of the functionality of this system is also planned for September 2025. Izvestia sent inquiries to the association of management companies.

How to eliminate falsification of decisions

Access to personal data of citizens of the Russian Federation is limited by Federal Law 266, which leads to contradictions with the Housing Code, which requires the creation of registers. But it is not clear enough how to make the voting of owners not only safe, but also convenient. If it is conducted not in GIS housing and communal services, but in person, then you will have to go around the apartments and deliver notifications.

The scheme of challenging the voting results, when citizens declare that their expression of will is falsified, has also not been sufficiently worked out, the deputy noted.

"Forgery of protocols is a criminal offense in our country,— said Sergey Pakhomov. — We also previously passed a bill according to which any meeting of owners is initiated by a specific person or official. He will be responsible for forged signatures and falsified decisions, if any.

Deleting residents' personal data from open registries will make it much more difficult to use them without the consent of the owners. However, it is unlikely to be possible to completely eliminate falsifications, as there remain risks associated with the direct collection of passport data of residents by unscrupulous persons, says Irene Parsamyan.
