In 2025, teachers' salaries were below the minimum wage in almost the entire country, according to monitoring data from the independent Teacher trade union. Its federal size was taken as the basis — 22,440 rubles. The lowest salary this year was recorded in Karachay-Cherkessia, Vologda Oblast, the Eastern Administrative District and Mordovia, in these regions it is below 5 thousand rubles. And the minimum rates of up to 10 thousand were revealed in 24 more regions. At the same time, in a number of areas, employers include remuneration when calculating additional payments to the minimum wage, which is paid for the additional workload of teachers — classroom management, checking written papers, running classrooms and working on holidays, according to complaints from teachers themselves. But this method of achieving the required minimum contradicts the position of the Constitutional Court and the Labor Code, social activists and lawyers remind.

Where are the smallest teacher salaries

In 2025, the lowest teacher rates were in Karachay-Cherkessia — from 2,369 rubles to 3,969 rubles. This follows from the monitoring of the independent trade union "Teacher" — public activists analyzed teachers' salaries, comparing them with the federal minimum wage. In the EAO, the teacher's salary is 3-4.7 thousand, in the Vologda region — 4253 rubles, in Mordovia — 4539 rubles. In another 24 regions, the minimum rates are above 5,000 rubles, but they do not reach 10,000. And in 46 regions, the minimum salary is below 20 thousand rubles.

And the minimum wage is higher only in three regions — Tatarstan and Primorsky Krai and Moscow. However, public activists note that they have not found data for three regions.

— It turns out that 90% of regions have salaries below the minimum wage, — stated Olga Miryasova, the trade union's organizing secretary.

Yuri Mirzoev, General Director of the Mitra National Law Company, confirmed to Izvestia that the total monthly salary of a teacher (salary + all payments not related to additional workload — for intensity, for category, for length of service, as well as incentive payments) cannot be lower than the minimum wage.

By itself, setting a salary below the minimum wage is not a violation if the total accrued salary, taking into account all allowances, is not less than the minimum wage. If the total amount is less, the employer is obliged to make an additional payment up to the minimum wage," he said.

How regions "wind up" salary data

But, as the trade union found out, the management of schools in the regions, when forming additional payments, include exactly the amounts that teachers are charged for additional work.

"We are being contacted by teaching staff of state educational organizations in Kabardino-Balkaria with complaints that employers, when calculating the supplement to the minimum wage, do not take into account the decisions of the Constitutional Court — they include in the calculation those payments that should be accrued after bringing the amount of payment to the minimum wage," says, in particular, in the appeal of public activists to the prosecutor's office. the region.

We are talking about the Constitutional Court's resolution of September 23, 2024. Then the court noted that, according to its constitutional and legal meaning, the system of current legal regulation does not imply the inclusion in the salary of a teacher, which does not exceed the minimum wage, "additional payment for performing additional work with the written consent of the teaching staff, which is not included in his main official duties."

Thus, the additional payment to the minimum wage should not include amounts for work in excess of the norm, as well as on weekends and non-working holidays, for performing additional work in the order of combining professions (positions), for classroom management, checking written papers, running classrooms, laboratories, workshops, training and experimental sites, and leadership of methodological associations..

Yuri Mirzoev explained that unfair calculations of minimum wage surcharges "eat up" legitimate surcharges, and called this practice a "massive violation."

This violates the norms of the Labor Code. According to the Labor Code of the Russian Federation, the basic part of the salary, that is, the salary for the standard of hours, taking into account the district coefficient, should not be lower than the minimum wage. Only after that all compensation payments are accrued," he said.

As follows from the billing sheets presented to the editors, such "inflated" surcharges are a regular story in many regions.

The public activists sent an appeal to the regional prosecutor's office with a request to check municipal regulatory legal acts in terms of their compliance with the decision of the Constitutional Court.

"If necessary, make representations on the elimination of violations of the law, as well as take other prosecutorial response measures in order to restore the labor rights of teaching staff," the appeals said.

According to Olga Miryasova, approximately 12 regions have sent letters to municipalities demanding that they conduct on-site inspections and report possible violations if they are found.

According to her, the supervisory authorities of the Kirov and Kursk regions, the Trans-Baikal and Stavropol territories, as well as Udmurtia, have done a good job.

The department also reported that they are constantly monitoring "ensuring compliance with the provisions of the Constitutional Court resolution." They also indicated that the average salary of a teacher at one rate in an urban area without compensation payments is about 23 thousand rubles, in the district center — about 24.5 thousand, and in rural areas — more than 26 thousand. But, according to trade union monitoring, the salary in this region ranges from 11 thousand rubles to 12.5 thousand rubles.

For example, the Vologda Oblast State Labor Inspectorate, commenting on a specific case of underpayment, reported that the head of schools "denies the fact of wage arrears." They also reported that, following a study of the explanations of the school's management and the lack of grounds for conducting an audit, the school "issued a warning" and "proposed to take measures to study and comply with the requirements establishing the procedure for paying salaries, taking into account the provisions on the minimum wage."

And the prosecutor's office of Karachay-Cherkessia reported that, following the results of the audit, representations were submitted to the chairman of the government of the republic and to local governments, the representations were "reviewed and satisfied." It is noted that the Ministry of Education and Science of the Czech Republic has developed a draft decree of the Government of the Czech Republic on the remuneration of employees of educational institutions, taking into account the position reflected By the Constitutional Court.

Lawyers recommend that teachers, in case of violation of their rights, contact the State Labor Inspectorate, the Prosecutor's Office, and the court to recover specific unpaid amounts.
